Terms & Conditions

Terms & Conditions

Effective date: 30 September 2026 · Version 1.6

Prototype / Beta: This is a demonstration product. Non-AI tool data is stored in your browser only. AI-powered tools are answered by Lotus Mind's self-hosted AI model (MiniMax M2.7). See Privacy Policy §8a. Tool outputs are illustrative and do not constitute professional advice.

1. Parties & Agreement

These Terms and Conditions (the "Terms") govern your access to and use of the Lotus Mind AI Hub (the "Hub"), a web application operated by Lotus Mind Limited, a company incorporated on 18 September 2026 in Ireland (Company No. 826314) (collectively "Lotus Mind", "we", "us", "our").

By accessing the Hub, creating an account, or using any tool or feature, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Hub.

2. Beta / Demo Status

The Hub is provided as a prototype / beta product. It is made available for evaluation, feedback, and early-access purposes only. The following conditions apply during the beta period:

  • Tool outputs in demo/preview mode are simulated. AI-powered tools (where indicated by the 🤖 AI system disclosure) are answered by Lotus Mind's self-hosted AI model (MiniMax M2.7) — no third-party provider. See §14 for full AI system disclosure.
  • Member profiles, tool-run history, and preferences are stored server-side in encrypted flat files operated by Lotus Mind Limited. Per-session AI inputs are transmitted to our AI provider (Lotus Mind's self-hosted AI model). You can retrieve a run for 30 minutes; its content is then no longer accessible and is permanently deleted from our servers within 30 days (on most tools the stored text is scrubbed within 30 minutes). Only run metadata (time, hashed IP address, tool used) is kept for 30 days for quality and abuse review. Your browser's localStorage holds session tokens and UI preferences only. See our Privacy Policy for full data-flow details.
  • Features may change, be removed, or behave unexpectedly at any time.
  • Service availability is not guaranteed and no SLA applies.
  • The prototype is not intended for commercial or production use.

These Terms will be updated when the Hub transitions to production. Material changes will be communicated in advance.

3. Eligibility & Age

To create a Hub account today you must confirm that you are 18 or over; we do not knowingly open accounts for anyone younger until the parent-facing verification step described in Privacy Policy §9 is live. The Hub is built as an age-aware service: every member is placed in an age band (child under 13, teen 13–17, adult 18+) from the date of birth or age given during onboarding, and the more protective band always applies. If your date of birth shows you are under 18, the child-safe path applies to you immediately — only the tools available to your band, personalisation off until a parent or guardian gives verifiable consent (GDPR Art. 8; Irish digital age of consent 16), and no paid plans. If you are a parent or guardian, you are responsible for any account you set up for, or consent to for, a child under 13.

You must have the legal capacity to enter into binding contracts in your jurisdiction. If you use the Hub on behalf of a company or other legal entity, you represent that you have authority to bind that entity to these Terms.

4. Acceptable Use

You agree to use the Hub only for lawful purposes and in a manner consistent with these Terms. You must not:

  • Use the Hub in any way that violates applicable Irish, EU, or international law or regulation.
  • Attempt to obtain medical, legal, financial, psychological, or other professional advice through the Hub. Tool outputs are for informational and illustrative purposes only; they do not constitute professional advice of any kind.
  • Submit false, misleading, or fraudulent information.
  • Attempt to reverse engineer, decompile, or extract source code from the Hub.
  • Attempt to gain unauthorised access to any part of the Hub or its underlying systems.
  • Use automated tools to scrape, copy, or harvest content from the Hub.
  • Transmit harmful, abusive, discriminatory, or illegal content.
  • Infringe the intellectual property rights of Lotus Mind or any third party.
  • Use the Hub for any commercial purpose not expressly authorised.

5. No Professional Advice

The Hub and its tools do not provide professional advice of any kind — including but not limited to legal, financial, medical, psychological, tax, or regulatory advice.

All tool outputs — including terms analyses, benefits checks, support responses, and AI-generated content — are provided for informational and illustrative purposes only. They may be inaccurate, incomplete, or out of date. You should not rely on them as a substitute for qualified professional advice tailored to your specific situation.

If you require professional advice, you must consult a suitably qualified professional (e.g. a solicitor, financial adviser, doctor, or accountant) registered in your jurisdiction.

6. Intellectual Property

All content, software, designs, trade marks, and materials on the Hub are the property of Lotus Mind Limited or its licensors and are protected by Irish and international intellectual-property law.

You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the Hub for the purposes set out in these Terms. No other rights are granted.

You retain ownership of any content you provide to the Hub. By providing content, you grant us a limited licence to process it solely for the purpose of delivering the requested service. Given the current prototype architecture, this licence is effectively exercised on your device (non-AI features) or via Lotus Mind's self-hosted AI model for AI-powered features.

7. Disclaimer of Warranties

To the maximum extent permitted by applicable law, the Hub is provided "as is" and "as available" without warranties of any kind, whether express or implied, including without limitation any implied warranties of merchantability, fitness for a particular purpose, non-infringement, or accuracy.

We do not warrant that: (a) the Hub will meet your requirements; (b) the Hub will be uninterrupted, timely, secure, or error-free; (c) any tool output will be accurate or reliable; or (d) any errors in the Hub will be corrected.

Nothing in these Terms limits your statutory rights as a consumer under Irish or EU consumer-protection law, including the Consumer Rights Act 2022 and the EU Consumer Rights Directive.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Lotus Mind Limited shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business, goodwill, or other intangible losses, arising from or in connection with your use of or inability to use the Hub.

Where liability cannot be excluded by law (including under Irish consumer-protection legislation), our aggregate liability to you shall not exceed the amount you paid to us in the six months preceding the claim. During the free beta period, that amount is €0; where statutory provisions prevent limiting liability to €0, our liability is limited to the minimum permitted by law.

Nothing in these Terms excludes liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded under Irish law.

9. Termination

We may suspend or terminate your access to the Hub at any time, with or without notice, if we reasonably believe you have breached these Terms or if we decide to discontinue the Hub or any part of it.

You may stop using the Hub at any time. Your account, profile, tool-run history and preferences are stored server-side (see §2). To delete them, use “Delete all my data” in Settings or e-mail [email protected] and we will erase your account data as described in our Privacy Policy. Clearing your browser data removes only the session token and UI preferences held in localStorage — it does not delete your account.

Provisions that by their nature should survive termination (including Sections 5, 6, 7, 8, and 11) shall do so.

10. Changes to the Terms

We reserve the right to modify these Terms at any time. We will publish the revised Terms on the Hub with an updated effective date. Where changes are material, we will provide reasonable notice (e.g. an in-app notice). Continued use of the Hub after revised Terms take effect constitutes your acceptance.

11. Governing Law & Disputes

These Terms are governed by and construed in accordance with the laws of Ireland, without regard to conflict-of-law principles.

Any dispute arising from or in connection with these Terms or the Hub shall be subject to the exclusive jurisdiction of the courts of Ireland. If you are a consumer resident in another EU Member State, you may also have the right to bring proceedings in your country of residence.

EU consumers may also use the European Commission's online dispute-resolution platform: ec.europa.eu/consumers/odr

12. Free-Tier Commitment

The following commitment is incorporated into these Terms by reference. In the event of any conflict between this Section and the Free-Tier Commitment document (version 1.3, September 2026), the Free-Tier Commitment document prevails. See the full commitment at lotusmind.one/free-tier.

12.1 Free-Tier Scope

Lotus Mind Hub membership starts free with no time limit, and the Hub's free-tier tools stay free for ordinary good-faith use. This is a founding commitment of Lotus Mind Limited.

AIKA AI Academy (aika.social) (AIKA AI Academy — free AI learning for children ages 8–15 and for adult learners on the everyday track) is free for every LotusMind member. Membership begins at our Free tier — which costs nothing and has no time limit. Registering is all it takes.

12.2 Wind-Down Notice (Acquisition or Discontinuation)

If Lotus Mind Limited is acquired, merged with another entity, or decides to discontinue the Hub's free tier or Aika.social, we will provide at least six (6) months' written notice before any change takes effect. During that notice period, users will have access to a data-export tool covering the full history of their data, and we will make a good-faith evaluation of open-sourcing the product or arranging a non-commercial handover. This obligation survives any change of control.

12.3 Change-of-Limits Notice

If we materially reduce the scope of any free-tier feature that is in active use (for example, by introducing usage caps, removing functionality, or adding fees to previously free features), we will provide at least ninety (90) days' written notice before the change takes effect. Notice will be given in-app and by email to registered users.

12.4 Data Export

Users have the right to export all data they have provided to or generated through the Hub at any time. During any wind-down or material change period, a data-export tool will be made available at no charge. Today, your account data is stored server-side: request a machine-readable copy at any time with “Export my data” in Settings (we answer within one month of receipt, extendable by up to two further months for complex or numerous requests (GDPR Article 12(3)), usually much sooner) or by e-mailing [email protected]; your browser's localStorage holds only your session token and UI preferences.

12.5 Fair-Use Limits

Free-tier usage is subject to fair-use limits to protect service quality for all users. Limits apply only where a user is acting in bad faith (e.g. automated scraping, deliberate abuse of the service, or circumventing access controls). Ordinary good-faith use by individuals and small businesses is not restricted.

12.6 Acquisition Protection

Any successor entity acquiring Lotus Mind Limited agrees, as a condition of any such transaction, to honour the Free-Tier Commitment for a minimum of six (6) months post-acquisition. We will include this obligation as a binding condition in any acquisition agreement.

12.7 Children's Data

Children's data — meaning data relating to persons under 18 — is never sold and never used for advertising purposes, including targeted advertising, profiling, or behavioural tracking. This commitment applies unconditionally and without time limit, including following any acquisition or change of control.

12.8 No Bait-and-Switch

The free-tier commitments in this Section are legal obligations, not marketing promotions. We will not introduce a trial period or expiry on free access that was previously offered as permanent, nor reduce the value of existing free access without the notice periods set out above.

§14 — AI Systems

Several features of the LotusMind Hub use large language model (LLM) AI systems regulated by Regulation (EU) 2024/1689 on Artificial Intelligence (EU AI Act). By using any AI-powered feature, you acknowledge and agree to the following:

  • Art.50 disclosure (provided at the point of interaction): You are interacting with an artificial intelligence system. Responses are generated by AI and may contain errors, hallucinations, or outdated information. Always verify important information with a qualified professional.
  • No professional advice: AI-generated content is informational only. It does not constitute legal, medical, financial, immigration, or other regulated professional advice. LotusMind disclaims all liability for reliance on AI outputs for regulated decisions.
  • Where AI requests go: AI requests are answered by a self-hosted AI model (MiniMax M2.7) running on Lotus Mind's own servers over a private encrypted link. No third-party AI provider or non-EEA sub-processor receives your words. Processing is based on your explicit consent when you choose to use an AI-powered feature. See the Privacy Policy for full details.
  • Reporting misleading outputs: If you believe an AI output is seriously misleading or harmful, please report it to [email protected].
